TERMS AND CONDITIONS Hobby Line v.o.f.
Article 1 - Definitions
- Provider: The General Partnership (VOF) Hobby Line v.o.f., located at Silversteyn 83 in Breukelen, The Netherlands, registered with the Chamber of Commerce under number 30242719, which offers products and/or services remotely to customers.
- Customer: The natural person who is not acting in the exercise of a profession or business and enters into a distance contract with the Provider.
- Service: The conversion of a photo uploaded by the Customer into a digital embroidery pattern in PDF format.
- Distance contract: An agreement concluded between the Provider and the Customer within the framework of an organized system for remote sales of products and/or services, whereby, up to and including the conclusion of the agreement, exclusive or partial use is made of one or more techniques for remote communication.
- Embroidery Pattern: The digital PDF file that is the result of the photo uploaded by the Customer.
Article 2 - Applicability
- These general terms and conditions apply to every offer made by the Provider and to every distance contract concluded between the Provider and the Customer.
- Before the distance contract is concluded, the text of these general terms and conditions will be made available to the Customer. If this is not reasonably possible, it will be indicated before the distance contract is concluded that the general terms and conditions can be viewed at the Provider's premises and will be sent free of charge as soon as possible at the Customer's request.
Article 3 - The Offer
- If an offer has a limited validity period or is made subject to conditions, this will be explicitly stated in the offer.
- The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to enable a proper assessment of the offer by the Customer.
Article 4 - The Agreement
- The agreement is concluded, subject to the provisions of paragraph 4, at the moment the Customer accepts the offer and fulfills the conditions set forth therein.
- If the Customer has accepted the offer electronically, the Provider will immediately confirm receipt of the acceptance of the offer electronically.
- Payments are handled via Mollie Payment Provider. Payment methods include iDeal, PayPal, and Bancontact. Payment must be made prior to delivery.
Article 5 - Delivery and Execution
- The delivery of the digital embroidery pattern takes place immediately after successful completion of the payment. There is no waiting time.
- The embroidery pattern can be downloaded directly from the website after payment, and a download link will also be sent to the Customer via email.
Article 6 - Right of Withdrawal and Cancellation
- Given the nature of the Service, it concerns a **digital product that is delivered immediately after payment**. For this reason, **it is not possible to cancel an order** or to exercise the right of withdrawal once payment has been completed and the embroidery pattern has been delivered. The Customer explicitly agrees to this upon purchase.
Article 7 - Liability and Use of the Pattern
- The Provider takes care in converting photos into embroidery patterns. Should the delivered embroidery pattern (PDF file) **prove to be corrupt and therefore unable to be opened**, the Customer is entitled to a refund of the paid amount. Customers must report this to the Provider via email.
- The delivered embroidery pattern is **intended exclusively for personal use** by the Customer. Commercial use, reproduction, distribution, or disclosure to third parties is not permitted without the express written consent of the Provider.
- The Customer is responsible for providing photos that are **free of third-party copyrights**. The Provider accepts no liability for claims arising from the Customer's use of copyrighted material. The Customer indemnifies the Provider against all claims from third parties in connection with the images provided by the Customer.
Article 8 - Customer Service and Complaints Procedure
- For questions or complaints, the Customer can contact the Provider via email or phone:
- In the event of a complaint about a corrupt embroidery pattern as described in Article 7.1, the Provider will **immediately refund the paid amount** to the Customer upon receipt and verification of the complaint.
Article 9 - Applicable Law and Competent Court
- All agreements between the Provider and the Customer to which these general terms and conditions apply are exclusively governed by Dutch law.
- Disputes between the Customer and the Provider concerning the establishment or execution of agreements relating to products and services governed by these general terms and conditions shall be submitted exclusively to the competent court in the Netherlands.
